Information We Collect 

A. Information You Provide to Us (Online and Offline) 

We collect information you provide when you register for a class or membership, request services (e.g., defensive driving, SmartDrive, workplace safety courses), submit forms, make a donation, contact us, or interact with us at events or by phone, email, or mail. Categories may include: 

  • Contact details (name, address, email, phone) 

  • Account and registration information (course selections, membership details) 

  • Driver and course information for defensive driving programs (e.g., driver’s license number if you seek a certificate/insurance discount) 

  • Payment information (processed by our payment providers) 

SmartDrive & DPPA: If you participate in motorvehiclerelated programs, we handle certain data in accordance with the federal Driver’s Privacy Protection Act (DPPA). We do not disclose protected DMVrelated personal information except as permitted by law (e.g., for safety, insurance, law enforcement, or other authorized purposes). [smartdriveusa.org] 

B. Information Collected Automatically 

When you visit our Sites, we and our service providers may automatically collect certain information about your device and browsing activities, such as IP address, device identifiers, browser type, pages viewed, referring/exit pages, and timestamps. C. Information from Third Parties 

We may receive information from schools, insurers, public partners, or platforms that help deliver our programs (e.g., class rosters for SmartDrive workshops or verification with agencies/insurers, where applicable) and from publicly available sources or service providers that support our operations. [delawaresafety.org] 

Personal Information (Definition) 

Personal Information” means information that identifies or can reasonably be linked to an identified individual (alone or in combination with other data). Examples include contact details; government identifiers (like driver’s license number) when you provide them for courses; and online identifiers. The definition may vary under applicable law. 

How We Use Information 

We use information for purposes including: 

  • Providing and supporting our programs and services (e.g., defensive driving, SmartDrive courses, workplace safety training), including registration, certification, and customer service 

  • Operating, maintaining, and improving the Sites, services, and user experience 

  • Communicating with you about accounts, registrations, schedules, certificates, updates, offers, and relevant program information (you can opt out of promotional messages) 

  • Safety, security, fraud prevention, legal compliance, and to protect our rights and users 

  • Analytics, research, and reporting to improve our programs and outreach 

How We Share Information 

  • Service Providers/Contractors. We share information with trusted vendors who perform services for us (e.g., hosting, learning platforms, payment processing, communications). They may use Personal Information only to perform services on our behalf and must protect it. 

  • Program Partners/Verification. For certain programs (e.g., SmartDrive defensive driving), we may share limited information with insurers or relevant state entities to verify course completion and eligibility for benefits, consistent with law. [delawaresafety.org] 

  • Legal Compliance and Protection. We may disclose information to comply with law, respond to lawful requests, protect our rights, users, or the public, or enforce our policies. 

  • Business Transitions. If we undergo a reorganization or similar event, information may be transferred as permitted by law.

Security of Your Information 

We use administrative, technical, and physical safeguards designed to protect Personal Information. No method of transmission or storage is completely secure; please use caution when transmitting information online. 

Mobile, Emails & Text Messages 

If you use our mobilefriendly resources or apps, or sign up for email or text updates, we will use that information to deliver communications and program information you request. You may opt out of marketing emails by using the unsubscribe link in our emails and opt out of marketing texts by replying STOP. Children & Teens 

  • Under 13 (COPPA & Delaware law): We do not knowingly collect Personal Information online from children under 13 without verifiable parental consent. Where we provide K12 or youth programming, any data collected is used only for the program and handled consistent with federal and Delaware requirements. [delcode.delaware.gov] 

  • Delaware Online Privacy & Protection Act (DOPPA): Online services directed to children must not market specified products (e.g., alcohol, tobacco, fireworks, etc.) to children, and operators with knowledge of a child user must not use the child’s Personal Information for prohibited marketing.   • Teens 13–17 (DPDPA): Delaware requires consent to sell or use a known minor’s data for targeted advertising. We do not sell Personal Information and will not engage in targeted advertising to known minors without required consent. Parents/guardians may exercise rights on behalf of their children where permitted. [delawarepublic.org][dwt.com]

We and our service providers may use cookies, pixels, local storage, and similar technologies to: 

  • Enable core site functionality (e.g., signin, session management) 

  • Understand usage (analytics) and improve content and services

Do Not Track / OptOut Signals: Some browsers send “Do Not Track” signals; industry standards are evolving. Delaware law requires recognition of a “universal optout mechanism” beginning January 1, 2026, and we process recognized browserbased preference signals (e.g., Global Privacy Control) for optouts of targeted advertising or sale as required. [dwt.com] 

Delaware Specific Privacy Rights (DPDPA) 

As a Delaware resident, you may have the following rights regarding your Personal Information, subject to exceptions: 

  1. Confirm & Access – request confirmation whether we process your Personal Information and access it. 

  1. Correct – request corrections of inaccuracies in your Personal Information. 

  1. Delete – request deletion of Personal Information. 

  1. Portability – obtain a copy of your Personal Information in a portable, readily usable format. 

  1. OptOut – opt out of (a) the sale of Personal Information, (b) targeted advertising, and (c) profiling in furtherance of decisions that produce legal or similarly significant effects.

Applicability notes: Delaware’s DPDPA (effective Jan. 1, 2025) applies broadly—including to many nonprofit organizations—subject to thresholds and exemptions (e.g., employment/B2B data is typically excluded). Non-Discrimination: We will not discriminate against you for exercising your privacy rights.
